The Right to Choose Your Own Doctor Is Protected by Law

Under the Illinois Workers' Compensation Act (820 ILCS 305/8(a)), injured workers are entitled to receive all necessary medical care — and critically, you are not required to see a company doctor. Illinois law grants you the right to select two treating physicians of your own choosing. Your employer's workers' compensation insurance is required by law to pay for all reasonable and necessary medical treatment related to your work injury.

You do not need your employer's approval to see Dr. Petzel. You do not need a referral. And you are never billed directly — all charges go straight to the workers' compensation insurer.

Important Deadline: In Illinois, work injuries should be reported to your employer as soon as possible. You generally have 45 days to report a work injury and 3 years from the date of injury (or 2 years from the last payment of compensation) to file a claim. Two Doctor Choices

Illinois gives you more freedom than most states. Here's exactly how the two-physician rule works — and why choosing wisely matters for your recovery.

First Choice

Your Primary Treating Physician

Your first physician selection is your primary treating doctor — the provider who directs your overall care, documents your injury, and manages your recovery plan. This can be any licensed physician, chiropractor, or healthcare provider you choose. Under Illinois law, once you select your first provider, all treatment from that provider — including any specialists they refer you to — falls under that single "choice." Seeing a specialist on a referral from your first doctor does not use up your second choice.

Second Choice

An Independent Second Opinion or Alternate Provider

Your second physician choice allows you to see a completely different provider if you are unhappy with your initial care, want a second opinion, or need a different type of treatment. This is a powerful right: if an employer-directed doctor clears you to return to work before you feel ready, or recommends against a treatment you believe you need, you can use your second choice to get an independent evaluation that carries full legal weight in your claim.

Important Clarification

What Counts as a "Choice"?

Under Illinois law, a physician "choice" is counted at the treating physician level — not every specialist visit. If Dr. Petzel is your first choice and refers you to an orthopedic surgeon or imaging center, those referrals do not consume your second choice. You retain that second selection for a genuinely independent provider. However, if you decide to switch primary treating doctors on your own — without a referral — that counts as using your second physician choice.

How the Billing Works

You Never Pay a Dime Out of Pocket

When you come in as a workers' compensation patient, we bill your employer's WC insurance carrier directly. There are no co-pays, no deductibles, and no out-of-pocket expenses for any treatment related to your work injury.

All you need to bring is your employer's name, their workers' compensation insurance carrier (your employer is required to provide this), your claim number if one has been assigned, and your date of injury.

Employer Cannot Force You to See Their Doctor. Your employer may suggest a company physician, but they cannot legally require you to use them as your treating provider under Illinois Workers' Compensation law.
